Rice subpoenaed
The Democratic congress has issued a subpoena for the Madame Secretary Condoleeza Rice. They want to talk to her about pre-war intelligence. Uh oh.
I’ve often said she is the master (mistress?) of a very sophisticated sophistry, well she’s gonna really need that talent for her hearings.
This letter has not been edited.
Isn't she immune from having to testify?

Not toally, no. The Executive Branch can use "National Security" - among other things - to greatly restrict the testimony; and has, many times, over the years, by both Parties.
(And, of course, she - as anyone - can always "take the 5th".)
But she is only an "employee" of Government/Executive- Branch; and only the President and Vice President are absolutely immune from even having to appear while in office.

Rice noted that she had been serving as President Bush's national security adviser during the period covered by the panel's questions and stressed the administration's position that presidential aides not confirmed by the Senate cannot be forced to testify before Congress under the doctrine of executive privilege.

The reason for the silence? Could it be that baby Jason's grandfather owns a BIG piece of Boulder. The suspect parents are NOT cooperating with the police. The last I heard they had fled Boulder! Gee I wonder why??????? Do you suppose Big Daddy Midyette is buying his son and his son's wife out of a murder charges?? I could understand your elation if the Midyettes were arrested. I would join your dance in the streets were that to happen!
I don't care about Condoleeza Rice, she will slime her way out of this. I am just saying you might want to check your prioritys when it comes to justice in your own town.

Executive privilege has been claimed before - and most probably will be again, more or less ad infinitum, ad nauseam, by whichever party's ox is being gored - or threatened with being gored - by Congress. Usually, it results in one of those nice, more or less "gentlemanly", political compromises, with both sides avoiding extreme "showdown at the OK Corral" tactics.
But, back when Nixon pulled that - when he was on his way down the drain, and was scrambling hard to avoid total disaster - the Supreme Court held that "executive privilege" was not "immunity". The "employee" had to appear - answer the Subpoena - BUT, the details of testimony could be kept confidential, or could be taken in closed hearing, etc., etc., to avoid problems with "National Security" and such like.
One of those legal "fine line" distinctions; but it does reflect the separation of powers, since the President and Vice President ARE immune during their terms of office. They don't have to even accept service of a Subpoena, as elected officials.
