Regarding Judge Blackburn’s decision to overturn the jury’s verdict in the firefighter’s case, has anyone asked the jury as to whether or not they were swayed by the evidence rather than by the plaintiff’s attorney’s behavior? Or asked how they feel about having their considered collective judgments overruled? If the judge was so incensed by the attorney’s conduct, why didn’t he declare a mistrial or censor him during the trial? Aren’t judges supposed to insure proper decorum during trials - isn’t that their job? And if Judge Blackburn was so outraged by what took place, why did it take him fifteen months after the trial to file this motion? Something is rotten in Denmark here. "Tell the judge the topic and he will tell you how it will turn out and evidence has nothing to do with it," says Justice Kirshbaum. Judge Blackburn heard the topic in the opening statement and decided before the evidence came in that the firefighter should not be rewarded for his chicanery. The next arbiter becomes the Appellate court and next is Supreme court until they run out of arbiters. The final arbiter will prevail.
