Did the system fail Neveah Gallegos?
The mother and boyfriend who are suspects in the death of three-year-old Neveah Gallegos will be released from custody today, reports Lynn Bartels.
Police need more time to investigate the death of Neveah Gallegos, and are waiting for her autopsy report, which might take several weeks to finish, DA spokeswoman Lynn Kimbrough said today. The girl's body was found one week ago today in a Lakewood ravine.The district attorney had sought two extensions before formally filing charges. The deadline for filing charges is today.
"By law, suspects cannot be held in custody indefinitely," Kimbrough said in a news release.
Police arrested the girl's mother, Miriam Gallegos, 20, and her boyfriend, Angel Ray Montoya, 22, both of Denver on Sept. 21, the day she was reported missing. The mother had told police how she and her boyfriend, a registered sex offender, tried to cover up the child's death and stuffed her body into a white plastic bag.
PREVIOUSLY:
Child welfare agencies had strong indications three-year-old Neveah Gallegos was abused but did not take aggressive protective action.

Doctors told social workers in July 2006 that 23-month-old Neveah had been sexually penetrated, causing bleeding in the diaper, according to a Denver's 7 report. The mother denied that her boyfriend, a registered sex offender, had abused the girl.In what is known as a voluntary case, Denver Department of Human Services allowed the girl to stay with her mother as long as she kept away from the boyfriend.
Shouldn't the mother's admission that she and her boyfriend tried to cover up Neveah's death and put the body in a plastic bag be enough to file enough charges to keep them in custody? Did the system fail Neveah?

Thank you sharing such a heartwarming story. I sinceerely mean that.
I used to live in a town where we had lots of immigrants, mostly from Mexico. Some situations were so horrifying it made you cry.
One of the churhes started a "Adopt a Family" program. Talk about rewarding.
We soon had programs within the program. We helped from getting them jobs to helping with things not allowed to be purchases with food stamps, diapers, soap, toiletries and the such. We started our own food and clothing banks, and activity programs with a family oriented themes. We also had church members qualified to do counseling.
Even if one did not have money to help, there was so much that took only and time, love and care.
Rewarding? You better believe it.

The team had not won a game at the time. Several of the children had no one from their families to cheer them on and give encouragement.
Several of us agreed to go. We car pooled and took refreshments for ourselves and the kid's (most had nothing to eat before or after these games).
The lady who arranged this gave each of us one or two children's names and their uniform number. Before the game we introduced ourself to the children and let them know we were to cheer for them.
Remember, this team had not won a game all season.
It turned out to be a most exciting time and experience. Those sweet kids won 11-0. Talk about turning sadness to joy. Most of these children were "system" children.
The celebration afterwards would have made a national pennant wininng team celebration sad.
The joy these kids had was all the reward we needed. Several of us, and more joined us, continued going to these games.
There's so very much we can do to help, from something as simple as a baseball game to getting involved guiding wayward mother's and father's to be responsibile loving parents to forcing the "system" to improve. A few hours a week could save a child. We just need to do it.

The grandmother raised problemed children, two had at least 2 babies well before the age of 18. The grandmother also had a son,a known pedofile and not registered for that address, living with her and these 4 children. The grandmother is also in ill health.

The only people that can truly help these children are…. Family, friends, schools. People that have insider information and is actually around the children more then a second or more.
I witnessed a child in a grocery store be repeatedly told by the mother to sit down in the cart, when her back was turned the child jumped up and grabbed for something and the cart moved making him fall. The mother put frozen peas on the Childs head and she was also in tears. These two just happened to be in the next check out line when the man behind me started up about child abuse blah blah because the child had a knot and starting of a bruise. The man wanted to call the cops and had his cell phone out until I told him to shut up, because I saw what had happened. But what if I hadn’t seen it happened ???? You can not start a witch hunt.
The only thing that can stop things like this is to not let stupid people have children I guess.
We require a license to get married, training and a license to drive a car, proof of income to buy a house, rent a house etc. but any person that can lay down can have a child. A person should have parenting classes and prove they can financially provide for a child before they can take them home from the hospital otherwise they should be put up for adoption.
I agree, a thorough and in depth investigation should be done but outside the system and we as the community should loudly demand it.

Mother gets called home and blood is involved and she and sex offender boyfriend stuff in trash bags and suitcase and dump her like a piece of trash in a ravine.
Now social services is doing an internal investigation.
Are they responsible for her death? YES! indirectly.
What should happen to sex offender boyfriend and the pathetic excuse of the mother, though she is not a real mother ,she is a breeder.
Both should get the death penalty and I hope sex offender boyfriend and mother get shanked in prison,because the state doesn't have the guts to follow through on the death penalty.
I would like to raise money after they are sent to prison and put bounty's on both their heads.
That's the least we can do.

The statement I made was to say that the MEXICAN government was corrupt, not the US govt. Please read the statement before spouting off. There is somebody stopping them. There is a very corrupt government in place, and the few that have been heroic enough to even try to challenge or shed light on it have been systematically executed. If Mexico was able to fix itself, you are correct, that would eliminate a lot of problems on both sides of the border. But organized crime has pretty much established themselves as the de facto rulers.
I realize that there a good and bad people of all nationalities in this country and world.
With that in mind if the Mexicans are so sincerely concerned about the bad reputation the bad of their nationality has caused them, why or why are they not out there cleaning up their community. Nobodies stopping them.
There's way to do it within the confines of the law and law enforcement and government agencies will be glad to help. Just get out there and ask what can be done and DO IT.

It is also about the questionable decisions made by a government agency that is supposed to help in the protection of children when abuse is reported. If you found the story to be about Niveah's family being Mexican illegals, then explain away how that take on the story relates to the fact that Chandler, his stepfather, and the stepfather's girlfriend were all white. Nice illogical argument.
First you say that White on Black crime is all over the media (a very dubious and typically unsupported argument- the type you always use). Then you say Black on white crime is totally ignored.
You then use Jena as an example. A highly reported instance of black on white crime simultaneously disproving BOTH arguments at once. Nicely done.
Yes, a woman being held captive for days and sexually abused by her captors was as story that clearly would not have been reported had the victim not been black. Are you mental? Did it get more press because it was a crime with racial context, probably. Would it have been a “non-story” if the victim was white? Of course not. But let’s not nitpick and give you full credit for this one.
So now you have one example. You claim you can’t get others because the sites are blocked (meaning you are probably trying to access racists group sites, but no matter).
If, as you claim, the liberal-biased mainstream media, is the one showering us in white on black crime headlines, then you should be able to access those sites and show examples. Since you have access to THIS mainstream media, why can’t you use that?

I'm a Mexican from Mexico and I will admit that I came to the United States illegally, and almost lost my life in doing so, because of the life around me in Mexico. But I knew one thing, that is that when I got here I would not live the decitful ways I was taught in my home country. Yeah, I was taught how to cheat the system and live under given laws of the United States.
When I got here I went to the proper agencies told them my situation and requested help to be here legally. It took awhile but it happened. Yes,I was in the system and thinking that my delay in processing for aid was because I'm Mexican was the cause was not so. I had problems because I was being honest.
I was determined to make my life here good. I got a job and went to school, thru the help programs offered through DDHS. I worked my axx off working and studying. It was not easy but my prayers, determination and honesty got me through.
Today I live outside the system, only asking for aid when I absolutely need it.
I have a decent life here but I too am upset with many of my fellow Mexican countrymen because a good precentage come here looking for the "GOOD & FREE" life, continuing to live the deceitful ways of cheating others, stealing what is not theirs and some have even killed in Mexico and have never been brought to justice.
My home country is a disaster and and many, many of my fellow Mexican countrymen are an embarassment who have brought disgrace to the Mexican hertiage.
If you have come to this country for a better life--like the American phrase goes "buck up" live by the laws here and stop you damn bitching or go home.

on about the 34TH day I called to find out what I would be receiving. The caseworker informed me my file was 3rd in the pile. We spoke for a few more minutes and hung up. Several days later I started having trouble contacting her. She would not return my calls. When she finally did she said she had 300 cases before me and it would probably be 45 days before i was approved.
I have no earthly idea why she suddenly stuffed me in the bottom of the pile. By this time I was living on Food Bank-mostly molded or uneatable and needing to find rental assistance elsewhere-a real problem in a city this size.
4 and I mean 4 months later-that was almost 6 months after my original application date-I finally had to obtain legal assistance to get my application processed and approved. By the time I received my funds I was near to living under a bridge.
Yes "THE SYTEM" is failing on both sides. When you say the system needs a thorough housecleaning, that needs to be done on a national bases with stricter guidelines for caseworkers and recipents. People also have to start taking more personal responsibility by getting off the system.

I get to do the clean-up of paperwork that is left behind by the caseworkers for the IT department. So I get to see who is doing a good job and who isn't. What is so sad is that the workers who do give a damn burnout very quickly. The ones who don't are the ones who should be fired, but aren't and stay until they get promoted (I have seen it happen twice) or go to another part of the unit. And about that "overloaded" statement that pops up, if the bad caseworkers would do their jobs in the first place on EVERY case, instead of the ones they want, there wouldn't be overload. YEs there are a lot of cases, but it depends on the caseworkers attitude. IF she likes the family, they succeed and they are out of the system, better of then when they got there. If she doesn't or the family complains about treatment or services then it drags on and on and on...a complete waste of resources.
There needs to be a thourough housecleaning with administrators (who used to be caseworkers) straight down to the intake workers. If only the media and the public could see how many cases are just like Neveah's and Chandlers, there would be a public outcry that children and families are being treated this way...or not treated at all when they should be.
I know many people who have come to this country, not only from Mexico but elsewhere, with goals to have a better life. Many need financial help which is only temporarily. A good precentage learn the language, the laws and get jobs and housing outside of the system.
Sadly there are a greater percentage who come here for the "FREE" life having already been taught how to work "THE SYSTEM", which gives a bad name to the non-abusers of "THE SYSTEM".
There are people living in other countries living off the American system by returning once or twice a year to be recertified. They have family members living here who take care of sending American money from "THE SYSTEM" to their homeland.
The abuse of the American "system" is so astronomical it's almost unbelieveable.
That does not give anyone from anywhere to take another life whether it be a child or an adult.

I really, REALLY hate that race has to be brought into it, but unfortunately i find myself agreeing with some of the blog assasins here. They pay taxes. DDHS was so involved with their lives, asked questions about mom and dad's sex life, made numerous visits to their house, their business, spoke with their clients, and basically opened their lives up for extremely high and unnecessary scrutiny. The parents had to get outside agencies involved on their behalf before the children were returned and DDHS got out of their lives. Neither parent did drugs or drank. The original allegation came from a daycare center they had gotten into a dispute with, strangely enough, over spanking (the daycare did, the parents didn't).
This is why I say the system failed this little girl (and Chandler and many, many other children). Where was all of the scrutiny for this mother? Why didn't they make her take all of the classes? Why was there never a court order from a magistrate or judge? Why was she not sent to Safehouse or Gateway for an interview (like the parents I mentioned because they had an argument in front of the caseworker because of the caseworker)? Why didn't DDHS order forensic exams? I have seen it happen to white and black families...but I have not seen a lot of hispanic families in the visit center, or at the courthouse, or in the parenting classes...
To whoever I said was mexican...NOT! I just get tired of every blog that Mark starts getting hijacked by the illegal immigration debates and the blog assasins.
And if you can't tell, I am on the inside so I see where the system is failing...that's why I am looking for another job somewhere else away from this madness.

He was given the opportunity to comply with the courts by attending a help program which he failed to attend. He also failed to register as prescribed by the laws of this country.
His probation officer probably didn't even know where he was most of the time.
Later he spent minimal time in jail and most likely did not take advantage of HELP programs offered there.
In cases such as this one she was offered help thru DDHS and must not have taken advantage of it. Her program would have taught her to keep herself and her child away from men such as Montoya. But she went back to him and most likely lied (happens all the time) to DDHS about her living arrangements. If DDHS would have known the most definitely would have taken Niveah and placed her either with the grandparents or her biological father-whichever party(ies) would have proven the most responsible.
Help is out there and more often than not it's FREE-paid by the taxpayers of this city.
Who failed them -- THEMSELVES.

Yes this story is tragic, but the question about the legal status of the murderers of this child is a valid one to ask. The race baiters and open borders crowd will try to pull a slight of hand and paint us all as racists and bigots - but the fact LEGAL Hispanics like you see this problem pretty much shuts down that attempt. I guess they would have to call you a bigot too, which is a bit of a stretch and they know it. But they will keep it up anyway.

I am also hispanic and am hard pressed to find any aspect of life in this country that is not adversely affected by illegal immigrants. Since my family came to this country more recently, I know the difficulties they faced to do things the right way and it makes those who have flaunted the law over and over again more exasperating. I stood up, most recently at Ken Buck's event in Greeley where I literally stood because there were no more seats left, in support of hearing the victims of illegal alien crimes. I am as disgusted by groups like La Raza and Mecha as shaggy is.
Yet in this case, I haven't seen or heard anything about the legal status of those involved, but one thing is certain. We wouldn't have to be pointing fingers at the justice system, or health and human services, or anyone else for that matter if that little girl's mother had done her job.

I am likely the most frustrated of anyone I know at the ridiculous impacts our state is facing as a result of illegal immigrants.
The primary concern in this subject is of course that this guy should have been jailed a LONG time ago regardless of race. The mother is not a mother at all. Surely, any real mother would never help conceal the murder of their own child?
However, it is entirely true that our police force, our schools, our jails, our hospitals, our insurance companies and yes, even child protective services- would be more efficient and have more resources to address every issue/case if all of us working, legal, tax paying Americans (even us hispanic ones) didn't see our tax dollars being spent on so many issues related to an abundance of illegals.
It's just so sad and embarrassing for me, someone who used to carry a hispanic last name and was proud of my culture...to see it day in and day out on the t.v. Crime after crime.
Sometimes, I am all too happy to sign my new married name (not hispanic) and leave it at that.

So they, did what? Dropped the case? I thought that scenario would cause Social Services to enter because the welfare of the child may be at risk even though there was insufficient evidence of a crime. And the mother's noncooperation should have been cause for a placement out of the home.
Which leaves me to wonder. Did the matter not get referred to Social Services because the parties were illegal immigrants and were barred by our legislation that says immigrants can't use state services? If that is the case, then the law needs to be amended to protect children. If the child is living in our state, then the government has a duty to protect, even if the child's parents are here illegally.

This child was nothing more then a welfare check. Who if given the chance will be replaced by another child from this mother and another. It is a system they live on. You weep for this child yes, so do I but what about the others to come. Baby for cash instead of love is also a crime, maybe this child can save others like herself. So instead of government cash they will put the babies up for adoption where they can go to homes where parents will love them and protect them.
Legal status if very important to protect these children! How do you track some one with a number of names and ss numbers?

Angel Montoya beat a little kid black and blue in 2003 while "babysitting" as his mom went to work, same modus operandi as the Niveah's murder. He was sentenced to 18 months of probation, which he violated and nothing much happened.
Our judges either take taxi cabs home or live at the office because that one was clearly drunk off his gourd and would have driven into the nearest tree. These articles should publish the names of judges who let child molesters and abusers off easy. At least then, it gives us option of voting not to retain these idiot jurists.
Child molesters are very charming while they're grooming their victims and everyone else in sight. A judge should know better and so should the law. Angel Montoya would have done better if he had still been serving the first tenth of a hefty sentence in prison on his 2003 crime. Instead, there's a little girl brutally killed by this subhuman piece of trash.
The system failed and yet another innocent child has been cruelly dispatched because Colorado is too busy prosecuting everything except that which truly deserves the bravest of punishments.

Back to subject, this girl was failed in any number of ways...First off, the justice system, for not putting the boyfriend away for longer, and for not better monitoring his useless life.
The mother failed her for not throwing his worthless tail out of the house, and not cooperating with law enforcement when this first happened. What is with women who stick with losers, anyway? There's no shortage of guys out there, is there?
DDHS also should have been able to better montior this situation. Too much demand for their services, and too little funding, as with many administrative services these days.
Truly, this is a tragedy.

She did not cooperate with the initial case against the guy, she apparently continued to leave the little girl in his care AND she did not call 911 when she came home to find the girl unresponsive. Her final act of failure was allowing that useless human to abscond with her to toss her out like a piece of trash. How can any human services agency help kids when mothers like that exist? One thing that was really shocking to me was that he had the empty duffel bag when he was caught by police, so said one article. That tells me he cared more about some stupid duffel because he bothered to take her out of it and seemed intent on keeping it. Child equals trash, stupid bag equals useful. I just don't get that.

Only through repeated community and media intervention will we see a change within the system of "human services". If the public KNEW what was really going on, there would be a public outcry. ONe case in particular, there are a set of parents, a complete PAIR of parents who had their children removed under the authority of a Christian daycare, and have fought to get their kids back. They have done EVERYTHING that has been asked of them by a lesbian caseworker (who has admitted she doesn't like men and thinks that kids don't NEED dads), and they still don't have all of their children back. Yet two children who should have been protected by the "human" services department (Chandler, Niveah) and under a much higher scrutiny have fallen through the cracks. WTF?
