Why was Francis Hernandez still on the street?

Police and immigration officials continue to deny ultimate responsibility for not getting Francis Hernandez off the street before last week's crash that killed three people.

Hernandez, an illegal immigrant who is accused of causing the wreck that sent two vehicles careening into an ice cream shop and killing a three-year-old inside plus two women in a pickup truck, was arrested nearly 20 times over five years but remained in the country.

Officials with Immigration and Customs Enforcement say it may just be that Hernandez, 23, had masqueraded as a U.S. citizen for so long that he flew under the radar.

Both police and immigration officials insist they are doing their part to enforce a 2006 state law designed to identify and deport illegal immigrants.

Statewide, Colorado law enforcement agencies forwarded the names of 16,000 suspected illegal immigrants to ICE last year.

In fiscal year 2007, which ended last Sept. 30, ICE identified 4,545 illegal immigrants in Colorado's jails and prisons, said ICE spokesman Tim Counts. Nearly 5,600 illegal immigrants were deported. The number deported is higher because it includes some illegal immigrants identified in earlier years.

This fiscal year, through Aug. 4, ICE has deported 4,792 illegal immigrants from Colorado, Counts said.

"We are working very hard. We are being very responsive," Counts said. "I understand some law enforcement may feel frustrated if we're not there when they snap their fingers. But like all law enforcement, we have finite resources."

The Center for Immigration Studies estimates Colorado's immigrant population at 435,000. Nearly one-third of those people are believed to be illegal.

Across the country, crimes involving illegal immigrants have become a lightning rod for criticism and fiery rhetoric, and it's no different in Colorado.

The arrest of Hernandez and subsequent revelation that he is an illegal immigrant from Guatemala has renewed a long-simmering and often acrimonious debate about immigration reform.

Burt Hubbard reports the tragedy may lead to new legislation or attempt to plug loopholes in what are considered some of the toughest immigration laws in the nation.

Republican lawmakers vowed Tuesday to propose a package of bills in 2009 to crack down on crimes by people who are in the country illegally.

However, the Democratic Party leadership said closing loopholes and better enforcement of existing laws should be the top priorities.

"Lawmakers can pat themselves on the back, fattening the statutes, holding press conferences or making noise," said state House Speaker Andrew Romanoff, D-Denver. "But the real test is does all that work actually solve a problem? And in this case, the answer is clearly no."

    3. Should this be added to the list of reasons you will be a one term governor?

    The list of Americans killed by illegal invaders grows longer every day. It is certainly on par with the deaths in Iraq that the left is so concerned about.     But let's not focus on the dems alone, 'cause they are just the providor of cheap illegal labor for the Repugnant's domestic and international cheap foreign labor machine. Remember, the first amnesty was bi-partisan, and the next amnestey (code words: "comprehensive reform")is supported by majorities in both parties.

    Both the parties agree that if they can't send our jobs to China, they will find a cheap mexican to do it here.

    Let's face the facts: Neither Party represents the citizens of this country, and neither party obeys the Constitution.

    Our democracy has been broken, and will remain nothing more than a plaything of our corporate elite (who have used china and crimigrants) to destroy our middle-class and partied like pigs with all of our money)until we restore the local voter as the main contributor to their local candidates.

    This is much more than an immigration issue; it is a fight over who controls our country and what they can do with it. Today, both of Our Parties are funded by corporate wealth, neither obeys the Constitution, and both loot the country when they have control of Congress.

    These people are Out of Control, and will continue to rob us of our wealth and rights with every tool at their disposal (Crimigrants) until we completely stop corporate bribery, take back our democracy, and restore our Constitutional rights.

    PS: The 14th Amendment CLEARLY states that citizens can only be born to residents under the jurisdiction of the US. Illegals cannot give birth to citizens.

    I have lost all of the little respect I had for Gov. Ritter, who as Denver DA was a big part of the problem of illegal immigrant felons continuing to roam our neighborhoods. How dare he take a sanctimonious tone in this matter and walk away from his personal responsibility for the suffering he caused by giving illegal aliens a walk when he had the chance to have them deported with a referral to the feds. He is a liar and a hypocrite.

    The DPS high school drop out rate is 48% and mostly latino/mexican students. And we continue to support this level of mediocrity. We continue to support illegals coming into this country without earning their way in. The latino citizens should be absolutely ashamed of someone named HERNANDEZ doing this terrible act upon innocent people of our city.....come on latino people wake up!!!!

Sounds to me like they are doing their job over and over again Did you mean to say blame local courts? Well, they don't have jurisdiction over immigrant matters as they pertain to federal law. The Federal Government (both sides of the aisle) are the only people culpable in this situation, it is THEIR mandate, and they have failed us for decades now.
